Monica Spear’s father today told MailOnline that he intends to fight for the custody of his five-year old granddaughter saying he wants to take her back to the US.

Rafael Spear, the father of the former Miss Venezuela murdered with her husband in a brutal street-side robbery on Monday, spoke as it emerged the little girl, Maya, has been told the shattering news and will attend her parents' funeral.

'It’s my aim to get Maya out of the country', Mr Spear said today in an interview at the couple's lying in state ceremony in Caracas’s East Cemetery. Ms Spear and her husband, Thomas Berry, will be buried side by side tomorrow.

'Maya is my priority now and I need the Venezuelan government to help me obtain her guardianship', he stated. 'We have an agreement with the Berrys that the best for Maya is to be outside Venezuela'.

Meanwhile, Thomas Berry's father, also called Thomas, who moved from Britain to live in Venezuela thirty years ago, insists that the decision over his granddaughter’s future 'has yet to be discussed'.

'We are leaving all decisions about Maya until after the funeral proceedings', he told MailOnline. 'Such things have a time and a place and it is improper to discuss them now. The most important thing is that Maya is safe'.

Should Maya remain with her British father's parents, she will move into their house in Los Palos Grandes, a secure and clean part of Caracas.

Rafael Spear, 61, who lives in Orlando, Florida, and is a project manager for Siemens said: 'I am an American citizen, my daughter was an American citizen before she was murdered, now I’m going to fight so that my granddaughter becomes an American citizen.

'This country is no place to grow up', he said, his voice choked by tears.

Maya is currently in the custody of Monica Spear’s cousins in Caracas.

While Venezuelan law states that an orphaned child’s custody is transferred to the maternal side, the fact that all of Monica Spear’s immediate family live outside the country may become problematic.

The Berrys, Maya’s paternal grandparents, have lived in Caracas for over thirty years and would be the preferred option for a government which is strongly anti-US.

Miss Venezuela’s Daughter Will Attend Parent's Funeral

The now-orphaned daughter of former Miss Venezuela 2004 learned that her parents were murdered in a roadside attack. The girl’s family kept the devastating news from her as she recovered from her own gunshot wound from the tragic Jan. 6 suspected robbery that claimed both her parents’ lives.

The family of former Miss Venezuela Monica Spear and her ex-husband Thomas Henry Berry have told the pair’s daughter Maya, 5, on Jan. 9 that both parents were killed when they were shot on the side of a Venezuela highway on Jan. 6. As the family continues to grieve the sudden loss of Maya’s parents and plan the funeral, they revealed the little girl will be in attendance at the somber ceremony.

Poor Maya was told of her parents’ murder just as she left the hospital after getting shot in the leg during the shooting that killed her parents while they were having their car towed on the side of a Venezuela highway.

The young girl was understandably “bewildered” by the news, but she is expected to attend the funeral of her parents in Caracas, the capital city of Venezuela, The Daily Mail reported.

Maya’s surviving family is grateful that she was able to survive the senseless shooting. “It’s a terrible tragedy what has happened to her and as long as we can give her time to recover we will be there for her,” Monica’s brother Ricardo told NTV24. “She’s taken a bullet to her leg and is injured,” he said Maya was treated at the hospital but luckily didn’t need surgery, reported The Daily Mail.

“We still don’t yet know whether Maya will remain in Caracas with us or go to Orlando to live with Monica’s parents,” Thomas Berry Sr. told the MailOnline. “We will discuss it with her family once the parents have been seen off properly. For the moment Maya is staying with some of Monica’s cousins in Caracas. The most important thing is that she is safe.”

Miss Venezuela 2004, Monica Spear Killed In Front Of Daughter

Gunmen killed a former Miss Venezuela (2004) and her British-born partner in front of their young daughter in an attack that shocked the crime-plagued nation, authorities said Tuesday.

Miss Venezuela 2004, Monica Spear Killed In Front Of Daughter

Monica Spear, a 29-year-old soap opera star, and Thomas Henry Berry, 39, were killed in what appears to have been a botched robbery after their car broke down on a motorway in northwestern Venezuela late Monday, police and prosecutors said.

Their daughter, five-year-old Maya Berry Spear, was wounded in the right leg but was stable after receiving medical treatment after a crime that put a harsh spotlight on Venezuela’s soaring homicide rate.

Five people have been detained and were interrogated in connection with the killings, Interior Minister Miguel Rodriguez said after a televised meeting with President Nicolas Maduro, who vowed to use an “iron hand” to crack down on crime.

The family was driving on a motorway when their car hit a blunt object that had been placed on the road, forcing them to pull over, said forensic police director Jose Gregorio Sierralta. There are suggestions that the object was deliberately placed there as part of a planned armed robbery.

Spear waved down a tow lorry, which stopped to help on the road between Puerto Cabello and Valencia in the state of Carabobo, Mr Sierralta said.

But as the two lorry workers operated the crane, five armed men emerged on the road.

The lorry’s operators fled to a police station about 1.5 kilometres away while the mother, father and child locked themselves in their car in a desperate attempt to shield themselves from the killers.

But “the criminals fired multiple shots at the vehicle” before fleeing without stealing anything, Mr Sierralta said.

Investigators impounded the couple’s car and took testimony from the two tow lorry operators.

Miss Venezuela 2005 Monica Spear Mootz

Spear, represented Venezuela and placed 5th at the 2005 Miss Universe pageant in Bangkok, Thailand, appeared in the Miami-based Telemundo series Pasion Prohibida and Flor Salvaje.

The dark-haired actress, who lived in Miami, was on holiday in her native Venezuela. She had posted videos of the countryside and herself horse riding on Instagram in the last couple of days.

Her husband was born in Britain but has Venezuelan citizenship.

“This is a massacre,” said Mr Maduro, who vowed to curb the country’s runaway violence during his presidential campaign last year.

“This violence is a sickness that we have,” he said from the Miraflores presidential palace.

Mr Maduro called some 100 mayors and governors to an urgent meeting on Wednesday to coordinate action against crime.

Venezuelans who work in movies, theatre and TV called a rally for Wednesday in Caracas to denounce the oil-rich country’s epidemic of street violence.

Venezuela is deeply divided between supporters and critics of the late populist president Hugo Chavez and his successors. NGOs and the government give different figures on just how dangerous Venezuela is to live in. But Mr Maduro made an appeal for this killing not to be used for political gain.

“I take my responsibility to the maximum,” the socialist leader said, warning the killers that “whoever wants to kill will see an iron hand”.

Venezuela has one of the world’s highest murder rates, with 79 homicides per 100,000 inhabitants in 2013, according to the non-profit Venezuelan Observatory of Violence.

The interior ministry, however, gave a lower murder rate of 39 homicides per 100,000.

Opposition leader Henrique Capriles, who refused to concede defeat to Mr Maduro in presidential elections last year, reacted to the killings by calling on his rival to put aside “deep differences and unite against the lack of security, as one bloc”.

The beauty queen’s killing shocked fellow artists in Venezuela, a country which is passionate about soap operas and the Miss Universe contenders it regularly produces.

Actress Gaby Espino, who lives in Miami, said she would never return to her home country.

“This is the day-to-day life in our country. We have all left Venezuela, fleeing in fear, terrified because this is the reality of our country. And today it happened to Monica,” Ms Espino told the Telemundo network.

“I love my country, but I won’t set another foot in Venezuela,” she said.

Venezuelan telenovela director Leonardo Padron said he was “absolutely saddened, horrified, speechless, over the murder of my dear Monica Spear! My God!”

Telemundo, a leading Spanish-language network in the United States, said in a statement that it was “deeply shocked and saddened by the horrible crime that hit our dear actress Monica Spear and her family.”

Jencarlos Canela, Spear’s American co-star and love interest in Pasion Prohibida, expressed grief on Twitter, writing: “I am speechless. I will miss you my friend @MonicaSpear.”

Addressing Spear’s daughter, he added: “My pretty, beautiful Maya, I love you. You are not alone!”.
